These Terms of Use (“Terms”) govern your use of innercalmwellness.co (the “Site”) and any software applications made available by InnerCalm Wellness (“we,” “us,” “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

This is our marketing and information website. It is not a patient portal, and it is not a substitute for professional medical advice, diagnosis, or treatment. Content on the Site — including descriptions of TMS, Spravato®, ketamine, VNS, IOP, medication management, and substance use treatment — is general information only.
Using the Site, submitting a contact or appointment-request form, or using the chat feature does not create a provider-patient relationship. That relationship begins only when you are accepted as a patient and complete our intake process. Always seek the advice of a qualified health provider with any questions about a medical condition, and never disregard professional medical advice because of something you read here.
Please do not submit detailed medical information through this Site or its chat feature. Your records as a patient are maintained separately in our clinical systems and are protected under HIPAA and our Notice of Privacy Practices, which you receive when you become a patient.
Individual results vary. Testimonials and reviews appearing on the Site reflect the experience of specific individuals and are not a promise, guarantee, or prediction of the outcome of any treatment. Eligibility for any treatment is determined by clinical evaluation. Insurance coverage varies by plan and is subject to verification and payer authorization.

We develop and operate proprietary software for practice operations, analytics, and administration (“our Software”), including software that connects to third-party business systems on our behalf. Our Software is provided for the internal business use of InnerCalm Wellness and its authorized personnel only. It is not offered to the general public, and no public download, account, or license is available through this Site.
Where we grant access to our Software, we grant a limited, non-exclusive, non-transferable, revocable license to use it solely for authorized business purposes and only for as long as authorization continues. You may not: copy, modify, or create derivative works of our Software; reverse engineer, decompile, or disassemble it; sublicense, sell, rent, or redistribute it; remove proprietary notices; or use it to access data you are not authorized to access. All right, title, and interest in our Software, including all intellectual property rights, remain with InnerCalm Wellness. Our Software is provided “as is,” without warranty of any kind. Access terminates automatically when authorization ends, and you must stop using it and delete any local copies.
The Site and its contents — text, graphics, logos, images, and layout — are owned by InnerCalm Wellness or its licensors and are protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Any other use requires our prior written permission. Third-party marks, including Spravato®, are the property of their respective owners and are used for identification only.
The Site may link to third-party websites and use third-party tools. We do not control those sites or services and are not responsible for their content, practices, or availability. Their terms and privacy policies govern your use of them.

Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here limits or alters any obligation we owe you as a patient under applicable law or professional standards.
You agree to indemnify and hold harmless InnerCalm Wellness from any claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Nassau County, New York, and you consent to that jurisdiction.
We may update these Terms; the “last updated” date will change when we do. Material changes will be flagged on this page. Continued use of the Site after changes take effect means you accept the updated Terms.
